  1. Definition(s):

    LingoPath refers to LingoPath Inc.

    ESL refers to English as Second Language

  2. Privacy Policy:

    LingoPath Privacy Policy will be updated on occasion, so please check back on regular basis to ensure you have read our current Privacy Policy.

    LingoPath is concerned about your right to privacy while accessing and using lingopath.com. We have created the privacy policy in order to demonstrate our commitment to your privacy. LingoPath abides by the Children's Online Privacy Protection Act of 1998 (COPPA) as further outlined in this policy.

    Please take the opportunity to review our Privacy Policy that follows

    At LingoPath we recognize that our members are concerned about the privacy of the information that we collect from our members and any possible use of this information.

    LingoPath collects personally identifiable information (name, e-mail address, etc.) and/or demographic data (city, postal code, zip code, organization names, interests, etc.) that you submit when you do the following:

    1) Register for our services;
    2) Complete a survey;
    3) Send us an e-mail; or
    4) Communicate with us by other methods such as telephone, online forums, chat, video conferencing or other communication tools or third-party software.

    We may use this information to process and maintain your account, compile demographic statistics about our users, and display to you information and advertisements that match your interests and profile. We will never sell your personal information to any company for any reason.

  3. Collection of Information:

    When you register as a parent/administrator/guardian or student, we ask for your name, e-mail address and other profile information. When parents/administrators/guardians register a student, we ask for their student's name, e-mail address, and other profile information. We may request additional profile information for optional online surveys and identification verification.

    When you register as a student, or when a parent/administrator/guardian adds a student, we may ask for credit card and billing information. That information remains secure and inaccessible to lingopath.com. For that reason, should you change your program enrollment (for example, from LingoLearn to LingoBiz, etc.), credit card information must be resubmitted. Credit card information can be submitted online during the online registration process. Alternatively, credit card information can be provided to a LingoPath representative when registering by fax or phone at a valid listed number on the Contact Us page on our LingoPath website. In these cases, the credit card information is entered into the system on behalf of the client and the information is secured and made inaccessible.

    In the course of using the LingoPath website, we log certain information, including your IP address, the browser you are using, and the previous URL you were visiting. Lingopath.com uses IP addresses (random numbers assigned to individual computers) to help administer our website and anonymously track content preferences and traffic patterns. We also use your IP address to help diagnose problems with our server and to administer our website. We use cookies (small text files transferred from our website to your hard drive) to recognize repeat users, track usage behaviour, and facilitate your access to and use of our site. Cookies do not damage files or allow anyone to access your personally identifiable information; they simply allow us to tailor information and advertisements to make your visits more enjoyable and meaningful.

    If you send us correspondence, such as e-mails or letters, or if other users or third parties send us correspondence about your activities on the website, we may store such information so that we can serve you better.

  4. Use of Your Information:

    Our primary use of your profile information is to provide you with a more personalized experience and service. We may use profile information for market research purposes and to generate aggregate reports on students' interests and behaviours. We shall not identify specific individuals in reports.

    On occasion we may use our customer information to improve our website's content, offerings, and layout, improve marketing efforts and review website usage. With your prior approval, we may use the information we collect to occasionally notify you about new offerings from LingoPath and special offers we think you will find useful. If you would rather not receive such notices, please contact us support@lingopath.com. We use your e-mail address and, in some situations, your postal address or your phone or fax number to contact you when necessary. (For example, an agent of LingoPath may contact you to ensure you are satisfied with the service or to update your account.)

    In the absence of a special relationship or without your consent, we do not pass on your profile information to any third party. Certain information, such as your password or credit card number, is not disclosed.

    We may disclose user information in special cases, for example, when we have reason to believe it is necessary to identify, contact, or bring legal action against someone who may be causing injury to or interfering with (either intentionally or unintentionally) LingoPath's rights or property, other LingoPath users, or anyone who could be harmed by such activities. We may disclose user information when we believe, in good faith, that the law requires it.

  5. Communication and Notification of Changes:

    If at some point we need to send you an English lesson through email, we would need to know your email address. As a student and LingoPath subscriber, you will be added to our mailing list to receive occasional emails about service updates, special offers, and promotions from LingoPath and other companies within the LingoPath partnership program/group.

    We will send you strictly service-related announcements on occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email.

    If there is a change to our information usage practices that affects your personal or identifiable information, we will notify you by e-mail of the relevant changes. At the time of that message, you will be able to opt out of this information usage by sending an e-mail message to support@lingopath.com. You should periodically check our posted privacy statement for changes.

  6. Control of Passwords:

    You are required to control your password as described in the LingoPath Terms of Use Agreement. If you have forgotten your password, please contact us at support@lingopath.com. Your password will be e-mailed to you shortly thereafter. LingoPath will never ask for your password in an unsolicited phone call or e-mail.

  7. Security:

    The security of the information you provide to LingoPath.com is important to us. We use encryption software, and other security measures to protect the loss, misuse, and alteration of sensitive information under our control. We use Secure Socket Layers (SSL) to encrypt sensitive data you send to us. Access to our site is password protected. A high-strength firewall protects our database from outsiders.

    This site may make use of forums and chat rooms. Please remember that any information you disclose in these areas becomes public. You should always be cautious about the amount of personal information you give to anyone in this context.

    We also insist on password verification at sign-in to protect against unauthorized access to your personal profile, activities and history on this site. If you leave the computer unattended without logging out of the site, we log you out automatically after some time has passed.

    LingoPath representatives who need the information to perform a specific task (for example, billing or customer service) are granted access to personally identifiable information. The personally identifiable information are kept and stored on computers/servers in a secure environment.

    LingoPath's site may include banner links to other sites from our sponsors, and when you choose to visit those sites, we are not responsible for their privacy policies or actions, and you should review the privacy policies of these parties when supplying personally identifiable information to them.

    While LingoPath provides extensive security procedures and practices, LingoPath cannot guarantee the security of your personal information or any other information provided over the Internet and will not be responsible for breaches of security.

    As is the case with all computer networks connected to the Internet, no method of transmission over the internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security.

  8. Consent:

    By using our website, you consent to the collection and use of the above-described information by LingoPath.

  9. Privacy Protection for Children:

    LingoPath urges parents, teachers and guardians to discuss with their children restrictions regarding the online release of Personal Information to anyone they don't know and to monitor their children's Internet activities. We strive to comply with the Children's Online Privacy Protection Act of 1998 (COPPA). Please read this Privacy Policy in its entirety to understand what Personal Information is collected from children on our website and how we use such information. We use best efforts to establish and maintain reasonable procedures to protect the confidentiality, security and integrity of personal information collected from children, although no assurances are provided.

    No part of our website is specifically structured to attract children under the age of 13, except as a student under the guidance and supervisions of an adult. Parental/Guardian consent is required in order for any child under 13 years of age to submit Personal Information to the LingoPath website and before LingoPath will use or disclose that Personal Information. Only a parent or guardian may register a child for access to LingoPath.

    We will provide to a parent or guardian, upon proper request and identification, the following information about their child: (i) a description of the specific types of personal information collected from the child, and (ii) the opportunity at any time to refuse to permit us further use or maintenance in retrievable form, or future online collection, of Personal Information from that child. Certain exceptions may apply to the foregoing provisions, pursuant to COPPA and other applicable law.

    If you are a teacher, school administrator, tutor or similar party, entering information about children, you represent that you have proper authority to submit the child's personal information, and agree to hold harmless LingoPath from any and all claims relating to the acceptance and use of such information.
